The state Department of Labor says the rate will not go up on January 1, 2027, because one of the 'off-ramp' conditions in the inflation-indexing law was met, so 2027 stays at $17.00 and $16.00. The state minimum wage law does not count clergy, members of religious orders, sextons, Christian Science readers, or volunteers of religious organizations as 'employees'; every other paid lay worker (office staff, payroll musicians, custodians who are not the sexton) must get at least the minimum. The Governor has proposed changing the off-ramp rules, so watch for news before 2028 budgets.",

New York's unemployment insurance rules ask the same basic question (supervision, direction and control), and labels, signed statements or a 1099 do not change the answer. In practice, a regular organist or sexton who works set services or hours under the rector's direction, on church premises and instruments, for regular pay, looks like an employee; an occasional substitute or wedding musician who runs an independent business looks more like a contractor. Clergy have dual status: usually employees for income tax, but self-employed for Social Security and Medicare (SECA) on ministerial pay, so the church does not withhold FICA from them, and a designated housing allowance is excluded from income tax but not from SE tax.",
